The Commission is concerned about the potential impact of Clause 115, which would remove sections 225 and 226 of the Housing Act 2004, and may have a negative impact on Gypsies and Travellers. Section 225 of the Housing Act 2004 places a duty on local housing authorities to assess the specific accommodation needs of Gypsies and Travellers (and Travelling Show people) residing in or resorting to (that is, passing through from time to time) their area. Section 226 of that Act gives the Secretary of State power to produce guidance on how the assessment is undertaken.

This Amendment would ensure that sections 225 and 226 of the Housing Act 2004 are retained.
