Briefing in support of the Motions that Clauses 9 and 15 should not stand part of the Bill or, in the alternative, Amendments 99, 100 and 102 to Clause 15 and Schedule 1

The Commission has identified a number of human rights implications arising from the Trade Union Bill.

We welcome the amendments to the Bill made in the House of Commons, and the Government’s decision not to proceed with certain additional restrictions on picketing, on which it recently consulted.

Nonetheless, our analysis suggests that certain Clauses of the Bill may not comply with the European Convention on Human Rights (ECHR), or with the UK’s international obligations under the United Nations (UN) and International Labour Organisation (ILO) treaties and the European Social Charter (ESC).
