Prosecution of Offences Act 1985 (Criminal Courts Charge) Regulations 2015 motion to regret

Section 54 of the Criminal Justice and Courts Act 2015 provides that courts must order adults convicted of an offence to pay a criminal courts charge. The Prosecution of Offences Act 1985 (Criminal Courts Charge) Regulations 2015 (“the Regulations”) supplement the requirements under sections of the Prosecution of Offences Act 1985 (“the 1985 Act”) for courts to impose a criminal courts charge on adult offenders convicted of a criminal offence.

The impact of these new charges on disabled defendants, particularly those with learning disabilities or mental health problems who may experience problems dealing with the criminal justice system, is of particular concern to the Commission. The Commission also notes research findings which are relevant to this issue may raise human rights concerns.
