The Commission welcomes the provisions in the Immigration Bill designed to tackle illegal working and enhance the enforcement of labour market rules. However, in our analysis, new powers contained in Part 2 relating to evictions and possession, potentially engage Articles 3, 6, 8, Article 1 Protocol 1, and 14 of the European Convention on Human Rights.
Proposed reforms contained in Schedule 8 to remove support for failed asylum seekers, including those with children, may lead to inhuman and degrading treatment, a breach of Article 3. It may also engage Article 3 of the UN Convention on the Rights of the Child.
On the issue of English Language requirements, the Commission is inputting into the Code of Practice.
